Welcome to Mahakal Residency. These Terms and Conditions govern your use of our website and the accommodation services we provide. By accessing our website, filling out an inquiry form, or becoming a resident at Mahakal Residency, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our services.
1. Definitions
- "We", "Us", "Our" refers to Mahakal Residency, its owners, and management staff.
- "You", "Your", "Resident" refers to the user of our website or the individual staying at our premises.
- "Premises" refers to the property, rooms, common areas, and facilities of Mahakal Residency.
- "Services" refers to accommodation, food, housekeeping, security, and all other facilities provided by us.
2. Use of Website
By using our website, you agree to:
- Provide accurate, current, and complete information in all forms and inquiries.
- Use the website only for lawful purposes and in accordance with these terms.
- Not attempt to gain unauthorized access to any part of the website or server.
- Not use the website to transmit any harmful, offensive, or illegal content.
- Not engage in any activity that could damage, disable, or impair the website's functionality.
We reserve the right to terminate or restrict your access to the website at any time without notice if you violate these terms.
3. Accommodation Services
3.1 Eligibility
- Our accommodation is strictly for male residents (boys/students/working professionals) aged 18 years and above.
- Valid government-issued photo ID (Aadhaar, Passport, Driving License, or Voter ID) is mandatory for all residents.
- Police verification is compulsory as per local law before move-in.
3.2 Booking and Rent Agreement
- A formal rent agreement or occupancy agreement must be signed before move-in.
- Booking is confirmed only upon payment of the security deposit and first month's rent.
- Rent is payable monthly, in advance, by the 5th of every month.
- Late payment may attract a penalty of ₹100 per day after the 10th of the month.
- Security deposit is refundable subject to the conditions outlined in our Refund Policy.
3.3 Room Allocation
- Room allocation is at the sole discretion of management based on availability.
- Room shifting requests are subject to availability and may incur administrative charges.
- Management reserves the right to change room allocation for operational reasons with reasonable notice.
4. House Rules and Conduct
All residents must adhere to the following rules to ensure a safe and harmonious environment:
- Entry Timings: Main gate closes at 10:00 PM. Late entry is allowed only with prior written permission from management. Repeated violations may result in eviction.
- Visitors: Only male visitors are allowed in the common areas during visiting hours (9:00 AM - 8:00 PM). Visitors are not permitted in private rooms. All visitors must register at the security desk.
- Alcohol & Substances: Consumption, possession, or distribution of alcohol, drugs, or any illegal substances is strictly prohibited. Violation will result in immediate termination and legal action.
- Smoking: Smoking is prohibited inside the building. Designated outdoor smoking areas are provided if applicable.
- Noise: Quiet hours are from 11:00 PM to 6:00 AM. Residents must not disturb others.
- Property Damage: Residents are liable for any damage caused to property, furniture, or equipment due to negligence or misconduct.
- Common Areas: Residents must keep common areas clean and not occupy them for extended personal use.
- Electrical Appliances: Only low-wattage personal appliances (mobile charger, laptop) are allowed. Heaters, induction cooktops, and other high-wattage devices are prohibited without written permission.
- Pets: Pets are not allowed on the premises.
5. Meals and Food Policy
- Meals are provided as per the agreed meal plan. Timings are fixed and communicated at move-in.
- Special dietary requests may be accommodated with prior notice, subject to feasibility.
- Outside food is allowed, but cooking in rooms is strictly prohibited. Common kitchen access may be provided on request.
- Meal skipping does not entitle residents to a refund or discount.
6. Security and Safety
- Management is not responsible for loss of personal belongings. Residents are advised to secure their valuables.
- CCTV cameras are installed at entry points and common areas for security. No cameras in private rooms or bathrooms.
- Fire safety equipment must not be tampered with. Fire drills may be conducted periodically.
- In case of medical emergency, management will assist in contacting emergency services, but is not liable for medical outcomes.
7. Termination and Eviction
Management reserves the right to terminate occupancy and evict a resident under the following circumstances:
- Non-payment of rent for more than 15 days after the due date.
- Violation of house rules, especially those related to safety, illegal substances, or visitor policies.
- Any criminal activity or behavior threatening the safety of other residents.
- Providing false information during registration.
- Failure to undergo mandatory police verification.
In case of eviction, the security deposit will be refunded as per the Refund Policy, minus any outstanding dues or damage charges.
8. Intellectual Property
All content on this website, including text, graphics, logos, images, and design, is the property of Mahakal Residency and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use any content without our prior written permission.
9. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of our services or website.
- Our total liability for any claim shall not exceed the amount paid by you for one month of accommodation.
- We are not responsible for temporary unavailability of amenities due to maintenance, repair, or circumstances beyond our control (force majeure).
10. Indemnification
You agree to indemnify and hold harmless Mahakal Residency, its owners, and staff from any claims, damages, losses, or expenses arising from your violation of these terms, your use of the premises, or your conduct as a resident.
11. Governing Law and Dispute Resolution
These terms are governed by the laws of India. Any dispute arising from these terms or our services shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in the city where Mahakal Residency is located.
12. Changes to Terms
We may modify these Terms and Conditions at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of the new terms.
